Appealing the Pflegegrad Decision: Deadline, Form, Procedure

Pflegegrad (care level) rejected or lower than expected? That is not the end of the road: the Widerspruch (appeal) costs nothing, initially takes only two sentences — and with the right preparation, the odds are good. Here is how to proceed without formal errors and without missing deadlines.

Check First: Is the Appeal Worth It?

The Pflegegrad depends on point ranges (§ 15 SGB XI): from 27 points Pflegegrad 2, from 47,5 Pflegegrad 3, from 70 Pflegegrad 4, from 90 Pflegegrad 5. A look at the assessment report shows how close it was: if the result is only a few points below the next threshold, the appeal is almost always worthwhile — often a single underestimated module makes the difference. The report is sent to you together with the decision; if not, request it — you are entitled to it.

Deadline and Form: This Is Where Most Mistakes Happen

Template (deadline-preserving): "I hereby file an appeal against your decision of [date], reference number [ref.]. I will submit the reasoning later. Please send me the complete assessment report." — date, signature, done.

The 5 Steps to a Better Outcome

  1. File within the deadline — send the two-liner immediately; do not wait for the perfect reasoning.
  2. Analyze the assessment report: compare the score for each module with everyday reality. Where was independence assumed that does not exist?
  3. Collect evidence: care diary (Pflegetagebuch) (the strongest tool), doctor's reports, medication plans, a statement from the care service.
  4. Submit the reasoning: concretely along the lines of the report ("Module 4: the report rates showering as independent; in fact, daily assistance is required, see diary p. 3").
  5. Attend the second assessment: a re-assessment often follows — this time have the diary ready and relatives present at the appointment.

Costs and What Comes After the Appeal Decision

The appeal procedure is free of charge (§ 64 SGB X). If the fund upholds its decision (Widerspruchsbescheid), you can file a lawsuit at the social court within one month — free of court fees for insured persons (§ 183 SGG), and a lawyer is not required there. And if the fund does not react at all for months, an action for failure to act is possible after three months (§ 88 SGG).

Does the appeal have to be justified right away?

No. To meet the deadline, a two-line letter without reasoning is enough ("I hereby file an appeal; the reasoning will follow."). You submit the detailed reasoning later, once the assessment report and the care diary have been analyzed.

Is a plain e-mail sufficient for the appeal?

Generally no. The law requires written form (with signature), a statement recorded at the fund's office, or a qualified electronic form — a plain e-mail usually does not meet this. Safe options are: a signed letter (ideally by registered mail), fax, or the fund's online portal with identification.

What does the appeal cost?

Nothing. The appeal procedure is free of charge. A subsequent lawsuit before the social court is also free of court fees for insured persons — a cost risk only arises if you voluntarily hire a lawyer.

How long may the Pflegekasse take to decide?

If the fund does not decide on the appeal within a reasonable time, you can file an action for failure to act (Untätigkeitsklage) at the social court after three months.

Can the Pflegegrad be downgraded because of the appeal?

Legally, a downgrade in the appeal procedure is not entirely ruled out, but in practice it is the absolute exception — the fund would have to hear you first. If you are unsure whether your assessment report really came out too low, get free care counseling beforehand.

I missed the one-month deadline — is everything lost?

Not necessarily: if the decision lacks the instructions on the right to appeal, or if they are incorrect, a one-year deadline applies. And regardless of that, you can submit a new application (upgrade application) at any time — it then takes effect from the new application month.
